Probate, Executor, and Trustee Support
Our attorneys and accountants provide support services for executors and trustees, including representation in Probate Court.
We prepare clients for the initial meeting with the Clerk of Probate Court and provide direction for accumulating and safe-guarding the property of the estate and the preparation of the initial inventory. After the probate estate is opened, and the executor is officially appointed, we provide guidance and assistance with the various accountings and inventory reports required by the Commissioners of Accounts and the Probate Court. We prepare and file Statements of Accounts with the Probate Office. We normally obtain and review IRS and state tax account infomation of the decedent, utilizing a Declaration of Representation initiated by the executor. Final income tax returns for the decedent are prepared to comply with tax regulations and to close the decendent's tax accounts. In addition, we prepare estate, inheritence, and trust tax returns when applicable.
Throughout the process we provide guidance to the fiduciary as they satisfy the full range of their responsibilities -- from the initial opening of the case through the final distributions and closing of the estate.
When appropriate, clients can appoint an attorney of our firm to serve as an executor or trustee.
